Terms and Conditions

1. Licensing

A valid and active license key is required to receive updates and support for Optimizer Pro. Your license key(s) will be sent to you via email, along with the download link, on completion of your purchase.

Each license is valid for one calendar year from the date of your purchase. Once a full year has elapsed, you can renew your license for another year at a substantially discounted rate. You may not share, distribute, freely give away, or resell your support/update license key.

Client site usage is permitted in situations where the license holder maintains an ongoing relationship with the client as a consultant. Providing Optimizer Pro as part of a service or web hosting solution, or including Optimizer Pro in a publicly-distributed WordPress theme (commercial or otherwise), does not constitute an ongoing client/consultant relationship, and individual licenses will need to be purchased.

2. Software updates

Updates are provided for a period of one year from the time of purchase, and will be delivered automatically from your WordPress dashboard.

After one year, the product will continue to function, however you must renew your license key, or purchase a new license in order to continue receiving updates and support.

A Personal license provides automatic updates for a single site.

A Business license provides automatic updates for 2 to 5 sites.

A Developer license provides automatic updates for unlimited sites owned by you or your clients.

3. Support services

One-on-one email support is provided for a period of one year after the purchase date for issues relating to NextGEN Gallery Optimizer Pro, and also its integration with the NextGEN Gallery WordPress plugin. To open a support ticket, please visit the Support page.

Please note, we will assist you in solving any problem you have with Optimizer Pro, however we do not provide general support for setting up WordPress, modifying your server, customizing your theme, or debugging NextGEN Gallery and other WordPress plugins we have not developed.

If you require support after one year, you must renew your license key, or purchase a new license. Only the license holder is permitted to request support.

4. Refunds

As we are offering non-tangible, unreturnable, digital goods, and as we provide a free version of the plugin for pre-purchase evaluation, we do not generally issue refunds after the purchase has been made. However, we will be happy to consider a refund within the first 30 days of your purchase if the plugin fails to perform its basic, documented functionality, and you have worked with the developer to try to resolve these issues.

Refunds will not be considered for product updates or annual renewals, and refunds will be granted at the sole discretion of Helpful Media.

Optimizer Pro is offered "as is", with no implied meaning it will function exactly as you would like. If you have an enquiry about a certain functionality, please ask us before purchasing.

Please note that absolutely no refunds will be given after 30 days from the initial purchase, and that refunds will not be considered if you simply decide not to use the product. We stand behind Optimizer Pro, and will assist you in solving any problem you have, however we do expect you to adequately understand what you are purchasing and why.

If you'd like to test the plugin on your specific setup before purchase, we encourage you to download Optimizer Basic at the WordPress plugin repository. Additionally, we have live demos of Pro features functioning right here on this site.

5. Delivery

After we have successfully processed your payment, you will receive an email confirmation with the download link and your support/update license key(s).

This email will usually be delivered within minutes of placing your order, however please allow up to one hour for it to arrive.

If you do not receive your email confirmation within one hour, please contact us.

6. Guarantee

NextGEN Gallery Optimizer Pro is guaranteed to function on a clean installation of WordPress (v3.7 to v4.7), running a clean installation of NextGEN Gallery v2 (v2.0.0 to v2.1.60), NextGEN Legacy (v1.6.2 to v1.9.13) or NextCellent Gallery (v1.9.14 to v1.9.31).

We do not guarantee Optimizer Pro will function with all 3rd party plugins, or with all web browsers, however we will assist you in solving any conflicts that occur.

7. Email communication

In addition to responding to your support tickets, Helpful Media may on occasion send you email notifications related to your NextGEN Gallery Optimizer Pro license and account.

Apart from an initial purchase confirmation with your download link and license key, these transactional emails may include license expiration reminders, notification of licensing changes, changes to our terms and conditions and other emails related to your purchase.

By purchasing NextGEN Gallery Optimizer Pro, you agree to receive these transactional emails.

8. Copyright and ownership

NextGEN Gallery Optimizer Basic, NextGEN Gallery Optimizer Pro and the NextGEN Gallery Optimizer website are the property of, and are copyrighted to Helpful Media.

9. Limitation of liability

9.1. To the extent permitted by law, we shall not be liable for any direct, indirect or consequential loss or damage (including without limitation, loss of business, opportunity, data or profits) arising out of, or in connection with the use or inability to use our products or website.

9.2. Helpful Media reserves the right to modify or discontinue (either temporarily or permanently) a support/update license with or without notice. This may be upon user request (Eg. associating a license key with a different domain), or to mitigate abuse.

9.3. This website is provided on an "as is" and "as available" basis without any implied warranty of any kind. We reserve the right to change or remove the website (either temporarily or permanently), or any part of it without notice.

9.4. We reserve the right to change these Terms and Conditions at any time, and with no prior notice.

10. Price changes

The prices of licenses for NextGEN Gallery Optimizer Pro are subject to change.

11. Acceptance

By purchasing NextGEN Gallery Optimizer Pro, you indicate you have read and agree to the Terms and Conditions detailed on this page.
